JUICE BAR 5 YEAR WARRANTY
1. Warranty
1.1 Juice Bar Energy (JBE) provides this Warranty to you who have purchased the Juicebar product(s) included in the sales package (“Juice Bar”).
1.2 JBE warrants to you that during the Warranty Period JBE will free of charge and in a reasonable time, remedy defects in materials, design and workmanship by repairing or, should JBE in its sole discretion deem it necessary, replacing the Juicebar in accordance with this Limited Warranty (unless otherwise required by law).
1.3 This Warranty is only valid and enforceable in the United Kingdom and its terms are governed by and in accordance with the laws of England and Wales and each party submits to the jurisdiction of the English Courts.
2. Warranty Period
2.1 The warranty period lasts for five years and starts at the time of Juicebar’s original purchase by the first end-user (“Warranty Period”).
2.2 As far as the law permit, the Warranty Period will not be extended or renewed or otherwise affected due to subsequent resale, authorised repair or replacement of the Juicebar. However, part(s) repaired or replacement product during the Warranty Period will be warranted for the remainder of the original Warranty Period.
3. Claims
3.1 If you wish to make a claim under this Warranty, please return your Juicebar to Juice Bar Energy at Home Farm, Westville Road, Frithville, Nr Boston, Lincolnshire PE22 7HL. You can call JBE on 01205 750254 (national or premium rates may apply) for further details on how to make a claim.
3.2 Any claim under this Warranty is subject to you notifying JBE of the alleged defect within a reasonable time of it having come to your attention and in any event no later than before the expiry of the Warranty Period.
3.3 When making a claim under this Warranty you will be required to provide the Juicebar; and the original proof of purchase.
4. Exclusions
4.1 This Warranty does not cover:
4.1.1 normal wear and tear;
4.1.2 defects caused by rough handling (including, without limitation, defects caused by sharp items, by bending, compressing or dropping, etc.);
4.1.3 defects or damage caused by misuse of the Juicebar, including use that is contrary to the instructions provided on Juicebar.
4.1.4 defects or alleged defects caused by the fact that the Juicebar was used with, or connected to, any product and/or accessory otherwise than for its express intended use; and/or
4.1.5 other acts beyond the reasonable control of JBE.
4.2 This Warranty does not cover defects caused by the fact that the Juicebar has been short-circuited or by the fact that the seals of the Juicebar battery enclosure or the battery cells are broken or show evidence of tampering or by the fact that the Juicebar has been used with equipment other than those for which it has been specified.
4.3 This Warranty is not enforceable if the Juicebar has been opened, modified or repaired by anyone other than JBE, if it is repaired using unauthorised spare parts, or if the Juicebar’s serial number has been removed, erased, defaced, altered or are illegible in any way and this shall be determined in the sole discretion of JBE.
4.4 This Warranty is not enforceable if the Juicebar has been exposed to moisture, to dampness or to extreme thermal or environmental conditions or to rapid changes in such conditions, to corrosion, to oxidation, to spillage of food or liquid or to influence from chemical products.
4.5 If the Juicebar is found not to be covered by the terms and conditions of this Warranty, then JBE reserves the right to charge a handling fee £5.00. When repairing or replacing the Juicebar, JBE may use products or parts that are new, equivalent to new or re-conditioned.
5. Limitation of UIS’ liability
5.1 This Warranty is your sole and exclusive remedy against JBE and JBE’s sole and exclusive liability in respect of defects in your Juicebar. This Warranty replaces all other warranties and liabilities, whether oral, written, (non-mandatory) statutory, contractual, in tort or otherwise, including, without limitation, and where permitted by applicable law, any implied conditions, warranties or other terms as to satisfactory quality or fitness for purpose. However, this Warranty shall neither exclude nor limit: i) any of your legal (statutory) rights; or ii) any of your rights against the seller of the Juicebar.
5.2 To the extent permitted by applicable law(s) JBE does not assume any liability for loss of or damage to or corruption of data, for any loss of profit, loss of use of Juicebars or functionality, loss of business, loss of contracts, loss of revenues or loss of anticipated savings, increased costs or expenses or for any indirect loss or damage, consequential loss or damage or special loss or damage.
5.3 To the extent permitted by applicable law, JBE’ liability shall be limited to the purchase value of the Juicebar. The above limitations shall not apply in case of gross negligence or intentional misconduct of JBE or in case of death or personal injury resulting from JBE’ proven negligence.
